Hey Enzabella, you are welcome to come to another latin country with cheap life and where betfair trading is (for now) 100% legal!

You might be almost owing me a couple of beers, so you can pass by and deliver them personally. Go Napoli!!

Hi all, sorry to bother you with this matter but, I think there may be people here that are from Italy and may be interested of the latest news. While I was searching about how to move my office to switzerland I have recieved a call from my lawyer and immediately after an email with a statement:

By the European Court of Justice news arrives that could revolutionize the Italian market. The Attorney General has indeed vindicated the English bookmaker Stanleybet: Italian law contrasts with the Community Treaty.

We told you just a month ago: a note of your calendar for Feb. 16. Punctual as a Swiss watch, it's final opinion of the European Court of Justice in this matter which involved the British bookmaker Stanleybet. And it is an opinion that can open unexpected scenarios on the Italian gambling market.

Momentous decision of the European Court of Justice
In summary the decision of the Advocate General of the European Court of Justice, has been recognized as the Italian rules are inconsistent with Articles 43 and 49 of the Community Treaty, concerning the principles of freedom of establishment and freedom to provide services, and are have defined the unjust sanctions imposed on operators and individuals.

Already the Italian Court of Cassation, in this matter, expressed his concerns on rules that, in fact, seemed to favor existing dealers openly, to the detriment of those who wanted to enter the Italian market. Now, with the judgment of the ECJ, it is easy to imagine that there will be many repercussions.

As we have already assumed, probably other operators and bookmakers will leverage on the judgment in favor of Stanleybet, which in fact could force the Autonomous Administration of State Monopolies again to review the regulatory system, starting from the mode of allocation of licenses.

My lawyer adviced me not to celebrate yet but, surely is a good news...

If this happens it will be really important for all the other banned countries, like France! Good luck :)

After the European Court of justice in favor of stanley there has been an other victory for the Italian gambling community.
Latest news from Italy.
The system is crumbling betting legal in Italy. "This is the feeling of several Italian players after the final pronouncement of the Court of Naples. On 19 March, the X-Section Review of the Neapolitan Court has in fact made public to the order with as: "you cancel the warrant to seize placed in the Warrant of the Court of Torre Annunziata on 16.2.2012." the seizure was made at a ctd that had been caught red-handed while collecting bets. the Court of Naples, while taking considered "art. 4, paragraph 4 bis, L. 401/89 which provides that the penalties provided in this rule apply to anyone, without the concession, authorization or license under Art. 88 of the Consolidated Public Safety Act, any organized activity taking place in Italy in order to accept or collect, including by telephone or online, gambling of any kind ", as established in the contested provision must be coordinated with the provisions contained in EC Treaty on freedom of establishment. the order will therefore be referred to the decision of the European Court of Justice of 6 March 2007 (the "Placanica" and cites the Supreme Court that "did not consider that there is crime in the event which an owner of a local Italian public has raised bets on the express mandate and on behalf of a foreign company where that company operates under the laws of EU law and has been unable to participate in competitions for award of licenses in that .... Article situation. Tulps 88 stands in conflict with Articles 43 and 49 of the EC Treaty ...). Hence the device so that annulled the seizure of ctd.

Looks like pretty good news. Similar decisions to follow on other countries?

Hi Caerd,
I have not heard news from France, Denmark, Holland, etc but it looks like that all the restriction applied by the above country s to protect their monopoly over gambling is in conflict of the articles 43 and 49 of the EC treaty. I am glad Italian users are fighting back this hypocrite prohibition. I think users from the above country s should also take this matter in front of a judge.

I have got some news from Betdaq too. The Italian market is very appetizing, if I was betfair I would be concerned.
Enjoy the read.

The Italian provider is preparing to launch its betting exchange platform built in partnership with the Irish Global Betting Exchange (GBE)
Microgame is preparing to launch its betting exchange platform after the signing of a partnership with the Irish Global Betting Exchange (GBE). The agreement is the culmination of collaboration between Microgame and Global Betting Exchange, a job which lasted for three years for the development of a platform for the betting exchange in Italy, which now allows the companies to "comply with the joint ambition to revolutionize the regulated market of Italian online betting . " The company plans to introduce the betting exchange as a complement to its product offerings under the "People's IBEX", which will use the services of the Italian BETLAB for the development of technical and commercial support.
"Microgame has chosen the best technology partner in the world, in order to introduce this revolutionary product and lead the Italian betting market in a new era," said Fabrizio D'Aloia, CEO of Microgame. "Importantly, People's Ibex should be considered as a competitor for the Italian traditional bookmaker, but instead as a great alternative and an opportunity to diversify their business. The betting exchange is an additional supply for our customers within their current portfolio along with poker, casino games, bingo, etc.. Our expectations are very high if we think of technological developments and business opportunities that will bring gaming operators and their customers. "
Brian O'Sullivan, executive director of GBE, commented: "We have long monitored the progress of Italian regulation on the betting exchange and I am pleased that we can finally tell us close to the point where Italian consumers will benefit from a full range of functionality of betting exchange for more than 10 years we have provided to users in the United Kingdom. We work for years with Fabrizio D'Aloia and Microgame and noted the success of the network model in the Italian market. Microgame is a perfect partner for GBE and believe that together we have the right skills and knowledge to succeed in the market in the Italian market. "

Hi Enzabella,

Thank you for sharing all that info about laws in Italy.
If I may ask: what's the latest about the legal situation for placing bets on betfair via the API? The stuff you wrote in February about enormous charges even for users making small transactions sounded very scary. I'm thinking about spending some time in Italia this year and I don't want to end up in jail :? :)

Also: somewhere you mentioned an Italian forum. Would it be ok for you to post or PM a link? Not that my Italian would be good enough, but Chrome should be able to help ...

The law has not been approved yet. I think they struggling to find a way around the artcicle 43 and 46 of the european treaty. However in the next month or 2, betfair.it may be legal in Italy. I don't think the italian forum worth to have a look. Italians are not ready yet to understand the basics of sport trading. I have my self reconsidered the fact of posting on this forum as I have recieved some dodgy offers. It's very hard to admit but unfortunaly italians have the idea the only if it's a scam would work. I have lernt my skill in britain and I know you can make money in a honest way so I strongly reject every approach which are not clear and seems dishonest so I decided today to abandon the forum so did my boyfriend.
Italian politicians can approve every law they wanted but as long the article 43 and 46 is there, you can't go to jail and if you did it would be for short time and with a nice compensation

Wow, that's good news for now! :P
I'll have to find out how much compensation that would be ...

That does support some prejudices about Italians but the only thing I would have hoped to learn about on that forum would have been the legal situation for accessing the bf API anyway. Thanks again for keeping all those who are interested updated. I for one will definitely be very grateful if you find time to go on doing that and let us know if things change ...

May it be possible to use the API from Italia in an honest and legal way for as long as possible :!: :P

If you use betangel, it will connect you to betfair without problems and without being blocked. You must have an English account. If you need to access betfair main page to withdraw funds, you just need to change DNS to:
208.67.222.222
208.67.220.220
For some poeple may seem to easy but it does actually work just by changing DNS.
If you bought chiavetta internet ( internet mobile key) for £110 euros a year, you can access to internet every where you wanted for 24 hours a day. There are some key mobile connection up to 8MB. ( fastweb is the best one around, TIM and 3 are the second best). If you bought Fastweb mobile internet connection, you don't need to change DNS, you can connect to betfair UK every time you wanted.
To get a contract you must have a national insurance number but, if you really move to Italy, let me know, I will look how foreign can access to this service without national insurance number. Unfortunaly pay as you go mobile connection are not available.
Good luck...ciao
