My experience of the US is that you can do whatever you want in a free market. As long as you have enough money and have the ear of legislators.
When Betfair were in NJ we tried to see if we could sell Bet Angel to NJ customers. The answer was yes, if we paid various fees including a $100k licence fee. Of course that completely excluded us from the market and killed any exchange start-ups. But of course established businesses were fine.
